- Reason for the Appeal: I was charged with Perjury for stating that I was fired from the DCT as both Inspections Manager and Building Inspector. When the state objected to perjury I provided evidence that shows I was fired in game from both jobs at the same time. Presiding Judge Relaxed then Charged me with contempt based on assumptions about the hierarchy of a grocery store which has no relation to the DCT. I explained in my motion to reconsider that this assumption is false as the previous 3 building inspectors all were able to continue in the department as Constructors and Building Inspectors after being fired without having to re-apply which the state agreed too. Relaxed went on to deny this motion after what it seems not reading it since he perceded to yell at me about trying to compel evidence in the secretary channel which I was not doing and only stated that if you do not believe what I am saying then please compel the commonwealth to confirm or deny.

DECISION ON APPEAL

In a 3-0 decision, the Supreme Court recognizes that Magistrate xtub12345 (and in fact, all District Court Magistrates) had no authority to make a ruling in a Federal Court case. Thus, because a Magistrate was allowed to rule in this case, it must be declared a mistrial.

As it is a mistrial, any and all court decisions within the case are to be immediately nullified. Any fines, jail times, charges, transfers, etc. are to be reversed. For all legal purposes, the case never happened.

If the Plaintiff still wishes to pursue this case, they must refile in the Federal Court.
