Protect employee privacy, employment security, and legal liability

The people of Democracy Craft, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:​

1 - Short Title and Enactment
(1) This Act may be cited as the “Employee Protection Act”.
(2) This Act shall be enacted immediately upon its signage.

2 - Privacy
(1) Private entities and Government organisations must ensure the maintenance of employee privacy for any records and or documents that bear employee specific data and or information concerning an employee.
(a) An employee's name, identifiers, personal information shall not be released to the public in relation to any administrative action taken against them (e.g. dismissal, termination, internal strikes etc.)
(b) An employee's personal information shall not be shared without their willing consent
(c) An individual / entity is guilty of Breach of Confidence when they fail to omit any of the aforementioned information from the public domain without employee approval, punishable for up to $10,000 in fines as decided by the court
(d) Congressional Subpoena and Court Orders are exempt from breach of confidence

3 - Dismissal
(1) Unfair dismissal is the unjust termination of an employee. (e.g. a position is made vacant only to be immediately filled)

4 - Deferral of Responsibility
(1) A government worker cannot be held legally accountable where there is a deficiency in training provided by the Government, where training would reasonably be required.
(2) A government worker cannot be sued for their individua actions in accordance with department policy in their line of work.
(a) The government department assumes all legal lability where policy is followed.
