Allow landlords more flexibility over how their property is used.​


The people of the Commonwealth of Redmont, through their elected Representatives and Senators in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the ‘Illicit Renting Act'.
(2) This Act shall be enacted immediately after it has been signed into law.
(3) This Act has been authored by Rep. ItsKatto and Dragon Law Firm.
(4) This Act is co-sponsored by lcn.

2 - Reasons
(1) Landlords don’t have much of a legal recourse in prohibiting undesired persons from renting on their properties.
(2) In a free capitalist republic, the right to enjoy the use of one’s own land is a fundamental right, as is the right to deny service to anyone.

3 - Illicit Renting
(1) No tenant shall rent any rentable region, including but not limited to, apartments, offices, storage, and commercial space, when the landlord prohibits the tenant from renting said region. Unauthorized renting of a region with restrictions shall be considered illicit renting, a summary offense carrying a $250 fine and immediate eviction of the tenant from the property at the discretion of the landlord.
(2) Restrictions on renting must be posted by the landlord before said restrictions can become legally enforceable. No tenant may be evicted if the region is rented before restrictions are implemented, but the landlord may prohibit the tenant from extending their rent. Unauthorized extension of rent shall be considered illicit renting.
(3) Posted restrictions must be posted on a sign or in a clearly marked and publicly readable book on a lectern, at every public entrance to the property. Failing to notice such signage shall not be a defense against illicit renting.
(4) No refunds shall be granted for rent paid in instances of illicit renting.
(5) Restrictions may include whitelisting or blacklisting individuals or occupations to rent or not rent on the property, being a new player, or any other reasonable reason, but restrictions that exist to deny the right to equality of people on the basis of sex or appearance shall be expressly prohibited.

4 - Codification
(1) This law shall be codified into the laws page on the forums. A new entry shall be made, “8.2 - Illicit Renting”.
(2) Section 8.2 shall read “The act of illicitly renting an apartment, office or other rentable region despite clear restrictions against the tenant renting the region is prohibited.
Per Offense: $250 fine and the landlord may have the tenant immediately evicted.”

Aye - Good to have codified, but this is already established through Supreme Court precedent (see Yeet_Boy v. Commonwealth in 2022)
