Case Filing
IN THE FEDERAL COURT OF THE COMMONWEALTH OF REDMONT
CIVIL ACTION
MrEntomology
Plaintiff
v.
bigpappa140
Defendant
COMPLAINT
The Plaintiff complains against the Defendant as follows:
bigpappa140 was hired to do a job, a job he failed to complete. Leaving the house in utter incompletion by abandoning the roof and interior fixtures such as walls, floors, and ceilings, he has scammed a man who just wants a decent house to live in. MrEntomology is here today, disappointed at what this situation has had to become to simply make everything whole. A contract was broken, and my client deserves justice.
I. PARTIES
1. MrEntomology (Plaintiff)
2. bigpappa140 (Tortfeasor and Defendant)
3. YeetGlazer (Witness)
II. FACTS
1. A contract was written between bigpappa140 and MrEntomology for bigpappa140 to build a house for MrEntomology.
2. The house remained incomplete for a long time, with the roof and interior fixtures being neglected by the defendant despite him collecting the last half payment from my client.
III. CLAIMS FOR RELIEF
1. A legally-binding contract under the Contracts Act where the plaintiff fulfilled all of his obligations was violated by the defendant, who failed to fulfill his obligations. The contract specified that the defendant would construct a complete home minus interior decoration, but that structural and exterior components would be complete. The roof is exterior and structural; walls, floors, and ceilings are certainly structural as well. The only thing bigpappa did not have to do was to furnish rooms and areas, but he did need to build the rest per the contract. He failed to do so in a timely manner, and told my client he completed the house. The house that was built was not good quality, with other people believing it is not up to par.
2. The plaintiff is therefore entitled to a range of damages per the Legal Damages Act.
IV. PRAYER FOR RELIEF
The Plaintiff seeks the following from the Defendant:
1. The plaintiff requests $6,000 in compensatory damages as $9,000 was paid and the job was incomplete. A partial refund is the fair remedy.
2. The plaintiff requests $10,000 in punitive damages as scamming someone and then claiming the build was complete is belligerent and outrageous.
3. The plaintiff requests $8,000 in consequential damages - loss of enjoyment in Redmont for the plaintiff was unreasonably deprived of a complete place of residence and had to furthermore go out of his way (and still does) to ensure its completion, including building the roof himself.
4. The plaintiff requests $8,000 in consequential damages - worsening of an existing condition for the plaintiff was unreasonably deprived of a complete place of residence. The existing condition is therefore the state of homelessness, which is a terrible state of being and this was made worse and made longer by the inaction of the defendant.
5. The plaintiff requests $9,600 in legal fees (30%) for retaining Dragon Law Firm.
V. EVIDENCE
