To

Establish a militia to protect and defend the Commonwealth of Redmont.

The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the 'National Militia Act' or ‘NMA’.
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been authored by Sen. Vernicia, Rep. Chaos_Canadian.
(4) This Act has been co-sponsored by Sen. Vernicia.

2 - Reasons
(1) A new country is being formed and Redmont is left in a vulnerable condition currently.
(2) The police are sometimes overwhelmed by murderers and troops are sometimes needed to keep the peace.

3 - Establishment of the Militia
(1) A National Militia (the Militia) is hereby established under the jurisdiction and control of the Department of Homeland Security, to be led by officers appointed by the Secretary of Homeland Security. The command structure of the Militia is subject to the Department of Homeland Security based on staffing and operational demands of the Militia.
(2) The Militia is composed of civilian volunteers who, with the exception of officers, do not maintain an active role in the Militia except when summoned in times of need, as specified in this act. The officers are paid as government employees in accordance with the government salary schedule, and volunteers may be reasonably compensated for deployments they partake in from time to time out of the Department of Homeland Security’s discretionary budget. In times of peace, the officers must be at least the rank of sergeant in the Redmont police force. In times of war, as declared by Congress, the officers may be drawn from anywhere suitable, and the Militia shall be placed under the direct command of the President of Redmont.
(3) The Militia shall be issued $50,000 in appropriations upon signage of this bill to purchase necessary supplies for its duties and make other purchases as is deemed operationally-necessary by the Department of Homeland Security.
(4) All volunteer troops shall, in times of need, have available to them by the Militia at no expense one AK-47 rifle, one P30 handgun, three stacks of ammo suitable for the AK-47, and one stack of ammo suitable for the P30. Troops shall also be provided food and armor protection in times of conflict at the discretion of the Department of Homeland Security. The Militia is authorized to use tenders to acquire all necessary supplies including but not limited to the equipment stated above, and to accumulate and store such supplies for times of need. The militia shall have available enough supplies to arm no less than 72 troops at any given moment, but may stockpile a reasonable amount of excess supplies.

4 - Use of the Militia
(1) The Militia shall remain dormant except when deployed in accordance with this Act.
(2) The Militia shall be deployed upon a declaration of war issued by Congress, or in response to a hostile act from a foreign power in which the President may deploy the Militia for a period no longer than 96 hours without the Congress authorizing an extension to this time or declaring war.
(3) In domestic states of emergency, the President may deploy the Militia for a period no longer than 24 hours. The emergency must be imminent or ongoing, and the nature of such an emergency must be at a gravity to which no other domestic agency is capable of quelling the emergency itself. Such states of emergency expressly include mass murder to a degree the police are overwhelmed and unable to respond, medical outbreaks where Militia logistical support is needed, acts of terror, and other disasters of such a degree.
(4) Any deployments may be extended or cancelled by Congress.

5 - Regulation of Personnel
(1) No member of the Militia, officer or troop, shall desert the Militia or fight against it in times of deployment, or they shall be guilty of treason.
(2) Militia members provided with equipment before or during deployment must return said unused equipment upon request by Militia leadership within 72 hours, warranted that an easily-accessible and asynchronous method of returning said equipment is made available to the member in question by the Militia.
(3) Failure to return said equipment in this manner shall be considered theft of militia property, a summary offense carrying a $100 fine and an additional fine equal to the value of the equipment in question.
(4) Each piece of equipment taken in this manner is subject to a separate count of this offense, but stacked items shall be lumped under one offense per stack, whether the stack is complete or not.

6 - Codification
(1) Theft of Militia Property shall be codified into the laws page on the forums. A new entry shall be made, “16.8 - Theft of Militia Property”.
(2) Section 16.8 shall read “The act of failing to return militia-issued equipment upon request within 72 hours.
Per Offense: $100 fine and an additional fine equal to the value of the equipment in question.”
