Amend the Constitution​

The people of Democracy Craft, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the “Pocket Veto Constitutional Amendment Act”.
(2) This Act shall be enacted immediately upon its signage.

2 - Reasons
(1) As it currently stands the President has the power to simply not respond as to whether to give assent or not, leaving bills in limbo where they haven’t been vetoed but they haven’t been enacted.

3 - Change
(1) “Once the Congress passes the bill, it is then sent to the President for their approval.” is changed to “Once the Congress passes the bill, it is then sent to the President for their approval. If 72 hours pass after the bill is presented to the President or Acting President for assent, the bill automatically receives assent unless vetoed before the 72 hours have passed

Explanation:
  • This amendment does not have any determination of when the 72-hour timeframe begins. It is very unlikely the President or even some of Congress will be aware immediately when the bill reaches a majority in the Senate. Therefore I'd expect that the 72-hour timeframe begins immediately upon the Speaker notifying the President that the bill has passed the Senate.
  • This amendment does not take into account a bill that is a complex change, which constitutionally requires that the President discusses with the Owner before being signed. This amendment would conflict as it could allow a complex change bill be passed while the President is waiting to communicate with the Owner.
  • The two points above are the most prevalent reasons for the veto of the amendment, however I would prefer that the amount of time be extended, given that some bills may require a few more days to consider. Especially if a new President is entering their office with a few bills in waiting.
