Amend the Constitution to Expand the Supreme Court’s Original Jurisdiction to All Instances of Removing and Banning Individuals from Public Office
The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:
1 - Short Title and Enactment
(1) This Act may be cited as the 'Removal and Banning of Public Officials Amendment Act'.
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been authored by Senator CaseyLeFaye.
(4) This Act has been co-sponsored by Senator CaseyLeFaye.
2 - Reasons
(1) Currently, the Supreme Court has original jurisdiction over the removal of public officials for very specific situations (“egregious constitutional offenses”), which are not even well defined. Due to the District Court’s original jurisdiction of “public official misconduct,” they currently have original jurisdiction over the removal of public officials. Having such a low level court have such power threatens our democracy.
(2) If the Supreme Court has original jurisdiction over the removal of sitting public officials, then it should also have original jurisdiction over banning from public office, because someone's court should not change due to whether or not they are in an elected position at the time of prosecution.
(3) This amendment also changes phrase’s structure to better mirror that of the other sub-subsections of subsection 21(1).
(4) To amend the Constitution.
3 - Amendment
(1) Section 21 of the Constitution shall be amended as follows:
“(1) Original Jurisdiction. The Supreme Court of Redmont has original jurisdiction over:
(a) The removal of public officials for egregious constitutional offences. Removing and/or banning individuals from public office.”
