Statement on the Censure of Judge Nacholebraa ​

The House of Representatives has officially voted to Censure and Impeach Justice Nacholebraa. It passed with a 6-1 majority. Having the Speaker and his Deputy abstain due to their personal connections with the Judge. The Censure proposal and reasoning can be seen here:

Pugbandit isssued a motion:​

I, pugbandit, hereby motion the impeachment and censure of the Honourable Judge Nacholebraa on the following grounds:​

1) The Honourable Judge failed to recuse himself in the following court case regarding the Presidential election despite having a direct relationship and being biased towards the Krix campaign. At the time, the Honourble Judge Matt stated "There has been no substantive evidence provided regarding the claim of a conflict of interest, only hearsay" which would suggest that the right Honourable Judge Nacholebraa had not bias towards the Krix campaign. However as seen in evidence below it shows that the judge did infact have a bias towards the campaign and yet still failed to recuse himself:​

- The FREACC act says:​

(1) A Judge should disqualify themselves from a case in which the Judge’s impartiality might reasonably be at question, including the following instances:​

(a) The Judge has a personal bias or prejudice concerning a party,
(b) The Judge has a financial interest in the subject matter.
(c) The Judge has a close relationship with an individual that is concerned within the case.​

2) The second questionable act that the Honourable Judge Nacho committed was a direct pledge to the people of Redmont to vote for a specific candidate on the day of the election. Infact directly saying ingame "Vote Krix" as you will see in the screenshots attatched. A direct statement to vote for a candidate by a judge does not infact show that there has been political bias but it questions the people's faith in the judicary. If there was to be more lawsuits related to electoral matters why would the people trust the judge to make a fair judgement when the FREACC act says:​

9 - Political Activities​

(1) While judges may endorse candidates for office in a personal capacity, they may not join any campaign in an official capacity nor excessively engage in political activity.​

(2) A Judge should not solicit funds or make a contribution to a political organization or candidate.​

(3) Judges may not use their office to the benefit of any political movement or campaign, including their own political enterprises.​

(4) Judges should refrain from giving their opinion on a contentious political matter.​

(5) Judges may not seek political office.​

Part one of section 9 has clearly been violated as saying to “Vote Krix” is infact a direct endorsement and by using /ad to the people of Redmont is in no way private. The fact that the judge is not meant to “excessively engage in political activity” is violated through numerous ads been published ingame. Part three is also in question with due to Krix in voice chat said that Nacho was in consideration for the DCT cabinet nomination meaning if Krix won the Judge would infact benefit from the campaign and by using status as a Judge he automaticaly has influence, meaning he is using his influence​

potentially for self gain. Part four is obviously violated with this being a divisive election, with results being tight and long discussions and debates it is clear this election was contentious and that the Judge advertising for a candidate is wrong of him.​

This motion received a majority in the house.​

The judge then avoided impeachment through resignation and the House believes that he must be tried in senate and that avoiding impeachment is unnacapteble.​

Representatives then brought up ideas of how the Honourable Judge may have slandered 1950Minecrafter as this screenshot was taken on the day of the runoff where there is only one other candidate and for a Judge to attack a candidate instead of refraining “from giving their opinion on a contentious political matter” (FREACC bill) saw some anger within the house.​

Although according the law we can not impeach Nacholebraa who should be tried in senate and has infact been voted to be tried, but through him finding a loophole so he cannot get impeached Representative Ice has put bills forward to ensure that the player will infact be put to the next stage of impeachment.​
