Provide Criminal Discretion Sentencing to the Courts​

The people of Democracy Craft, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the “Criminal Court Sentencing Act”
(2) This Act shall be enacted immediately upon its signage.

2 - Purpose
(1) The purpose of this bill is to provide further discretion to the courts in determining the punishments for crimes.

3 - Crime Categories
(1) If any of the following charges in the respective categories in the Rules and Laws are brought to the courts against a defendant, the courts may sentence a maximum to:
(a) 6.0 - Property & Building Regulations: $2000 Fine + 20 Minutes Jail
(b) 9.0 - Wilderness & Wildlife: $2000 Fine + 30 Minutes Jail
(c) 10.0 - Commerce: $20,000 Fine + Fine of Company Funds + 60 Minutes Jail
(d) 11.0 - Business: $20,000 Fine + Fine of Company Funds + 60 Minutes Jail
(e) 12.0 - Medical: $1000 Fine + 20 Minutes Jail
(f) 13.0 - PVP & Trespassing: $1500 Fine + 60 Minutes Jail
(g) 14.0 - Transportation & Roads: $1000 Fine + 20 Minutes Jail
(h) 15.0 - Miscellaneous Laws: $5000 Fine + 40 Minutes Jail
(2) The maximums shall not apply, and may be exceeded, in individual laws that specify penalties, in fines and any other applicable sentence, over the respective category amount.

Amend the Criminal Court Sentencing Act​

The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the "Sentencing Quickfix Act"
(2) This Act shall be enacted immediately upon its signage.

2 - Purpose
(1) The purpose of the Criminal Court Sentencing Act was to provide more discretion to the courts, by instating maximum fines and jail time for each respective laws category in the Rules & Laws. The issue with such act in its current form, is that some specific laws have fines and jail time well over the set maximum for the respective category.
(2) This bill is a simple amending fix to allow laws with punishments that are more than the category maximum to be exempt from the maximum, to prevent conflict of law.

3 - Amendments
(1) Section 3 of the Criminal Court Sentencing Act adds:
"The maximums shall not apply, and may be exceeded, in individual laws that specify penalties, in fines and any other applicable sentence, over the respective category amount."

Repeal the Criminal Court Sentencing Act

(1) This Act may be cited as the 'Judicial Sentencing Quick-fix Act'
(2) This Act shall be enacted immediately upon its signage.

2 - Reasons
There are a number of reasons that this bill should be revoked:
(1) The act is written in an ambiguous manner
(2) The act undermines the very fabric of our democracy in that it allows courts to blanket disregard sentencing conditions set by the legislature on every criminal offence - to the point where individual sentencing guidelines for each law may as well not even be added to bills.
(3) If we want to allow judges more discretion, the legislature can provide more dynamic sentencing guidelines (i.e. Maximum fines/punishments rather than fixed fines/punishments).
(4) The legislature recently knocked back a bill proposal to make contempt of court punishable of up to $5,000. The agreed amount passed into law was as low as $1500, but using the Criminal Court Sentencing Act they can bypass those sentencing guidelines.

3 - Repeal
The Criminal Court Sentencing Act will be repealed.
