Protect employee privacy, job security, confidentiality, and legal liability.

The people of Democracy Craft, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the “Employee Protection Act”.
(2) This Act shall be enacted immediately upon its signage.

2 - Reasons
In summary this bill is to protect hard working, department policy following employees from litigation. Additionally, this bill requires that Businesses and Government organisations don't share any information about their employees without the employee's consent. e.g. The employee was fired.

3 - Privacy & Confidentiality
(1) Private entities and Government organisations must ensure confidentiality when handling a current or past employee's private information.
(a) An individual's personal information shall not be shared by an entity without the individual's willing consent.
(b) Personal information includes remuneration (bonuses, allowances, & pay), administrative action taken against the employee (dismissal and or punishment), and or anything beyond these examples which may be considered of a personal nature, that if released, would be adverse to the individual.
(c) An individual / entity is guilty of Breach of Confidence when they fail to omit any of the aforementioned information from the public domain without employee approval, punishable for up to $10,000 in fines as decided by the court.
(d) Any information shared as part of official Congressional or Court proceedings; or that is general in nature, is exempt from breach of confidence.

4 - Unfair Dismissal
(1) Unfair dismissal is the unjust termination of an employee. (e.g. a position is made vacant without reason only to be immediately filled).

5 - Deferral of Responsibility
(1) A government worker cannot be held legally accountable where there is a deficiency in training provided by the Government, where training would reasonably be required.
(2) A government worker cannot be sued for their individual actions when they are in accordance with department policy.
(a) The government department assumes all legal liability where policy is followed.
 
This bill is hereby vetoed.
Reasoning:
  • Deferral of responsibility is not well defined and leaves room open for determination in court over every firing.
    It essentially shifts the blame off of the employee and places it on the employer for being at fault for issues that could be solved by having common sense on the part of the employee.
