Establish Offences under the Standardized Criminal Code

The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the ‘Health and Medical Offenses Act'
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been authored by: The_Donuticus

2 - Reasons
The current system of sorting crimes is too chaotic and messy. This Act exists as part of the Standardized Criminal Code package of bills to address this.

3 - Criminal Code
The Health and Medical Offenses Act will establish the crimes outlined in '4 - Offences' as an extension of the Standardized Criminal Code Act.

4 - Offences
(1) Disease Faking (Original: Icypenguin79 - Feb 15, 2021)
(i) Classification: Summary Criminal Offense
The act of faking a disease in bad faith.
Per Offense: $100 Fine

(2) Infection
(i) Classification: Summary Criminal Offense
The act of transmitting a disease to another player, the refusal to follow health directives to contain a disease, the refusal of treatment of a contagious disease in a timely manner, or the unconsented cause of a non-contagious disease/diagnosis/injury.
Per Offense: $100 Fine

(3) Unauthorized Health Treatment Possession (Original: LilDigiVert - Nov 28, 2021)
(i) Classification: Summary Criminal Offense
The act of possessing a health treatment — specifically, one that can only be crafted by Doctors but not Pharmacists — outside of areas designated by the Department of Health.
First Offense: $500 Fine + 5 Minutes Jail Time + Report to Health Secretary
Second Offense: $1,000 Fine + 10 Minutes Jail Time + Report to Health Secretary
Subsequent Offenses: $2,000 Fine + 15 Minutes Jail Time + Report to Health Secretary

(4) Unauthorized Medical Sales (Original: 218218Consumer - Sep 12, 2021)
(i) Classification: Indictable Criminal Offense
The act of distributing selling, distributing (including for free), or trafficking any health treatment — items that can only be crafted by Doctors and/or Pharmacists — without approval from the Department of Health. This also includes selling pharmaceutical items in a pharmacy not approved by the Department of Health, even if the seller has approval to sell elsewhere.
Minimum Sentencing: $1,000 Fine
Maximum Sentencing: $20,000 Fine + 60 Minutes Jail Time

(5) Doctors Selling in Bulk
(i) Classification: Summary Criminal Offense
Doctors, not Pharmacists, over-supplying medical objectives required to treat an illness.
1st Offense: Verbal Warning + Report to Health Secretary
2nd Offense: $80 fine + Report to Health Secretary
3rd Offense: $100 fine + Report to Health Secretary

(6) Unauthorized Pharmacy Rental
(i) Classification: Summary Criminal Offense
The act of renting a public rental space designated by the Department of Health as a pharmacy without approval from the Department of Health.
1st Offense: $100 Fine + Immediate Eviction
2nd Offense: $500 Fine + 10 Minutes Jail Time + Immediate Eviction
Subsequent Offenses: $1,000 Fine + 20 Minutes Jail Time + Immediate Eviction

5 - Clarification
(1) The terms “Doctor” and “Pharmacist” are used here as they are used by the Department of Health and the Department of Education.
(2) In addition to the punishments for an offense, the funds or assets acquired from an offense covered in this Act can be seized by the Government in court proceedings with a fine of an amount up to and equal to the total proceeds of the offense committed.

2 - Reasons
(1) Since the passage of the Health and Medical Offenses Act, we have experienced much inflation. So, these fines for these crimes are being increased.
(2) Jail time is being added as a punishment for these crimes as a further deterrent. Infection especially needs jail time, as it is a public safety issue.

(1) The Health and Medical Offenses Act shall be amended as follows:

Maximum Sentencing: $2,000 Fine + Suspension from Department of Health for a period of up to 2 months​

(6) Entering an Ambulance Without Permission​
(i) Classification: Summary Criminal Offense​
The act of entering an ambulance without permission from the Paramedic who owns it.​
Per Offense: $60 fine​
(7) Doctors Selling in Bulk​

(1) The Department of Health is revamping the Pharmacist job. This Bill seeks to allow the Department of Health to punish those who rent their pharmacies without a license.
(2) This Bill also seeks to redefine the crimes related to possession and selling of medical items. Note that there is no restriction on the possession of pharmaceutical items.
(3) To amend the Health and Medical Offenses Act.

(2) The crime of Unauthorized Pharmacy Rental shall be added as the newest entry of the Section 12.0 - Medical of the Laws Page. All crimes amended in this Act shall be updated accordingly in the Laws Page.
